Freedom of Information

The Freedom of Information Act 1982 (the FOI Act) gives the Australian community a legally enforceable right of access to information held by the Commonwealth Government.

If you want to obtain access to a document or documents that may be held by NOPSEMA, you will need to submit a formal FOI request. Some documents (or parts of documents) may be exempt from disclosure such as those relating to issues of national security and material obtained in confidence and various other matters set out in the FOI Act.

How to make a FOI request

Your request must:

  • be in writing (letter or email);

  • state that the request is an application for the purposes of the FOI Act;

  • provide information about the document(s) to assist us to process your request; and

  • provide an address for reply.

Fees and charges

Although there is no application fee for lodging an FOI request, charges may be imposed for processing. This excludes applicants who are seeking access to documents containing their own personal information, who are not required to pay any charges.

The most common charges are:


Search and retrieval

Time spent retrieving a document

$15 per hour

Decision making

Time spent deciding to grant or refuse a request, including examining documents, consulting with other parties and making deletions.

First five hours: Nil

Subsequent hours: $20 per hour

Provision of documents

Includes photocopying, packaging and postage

10c per page

If we decide to impose a charge, we will provide a written estimate and the basis of our calculation. Where the estimated charge is greater than $20, we may request that a deposit be paid before we process the request.

NOPSEMA may also decide to remit, reduce or not impose fees and charges for any reason, such as financial hardship or general public interest if this can be established by an applicant.

Request process

NOPSEMA will process all FOI requests within 30 days unless:

  • the subject matter is more closely connected to another agency, which may result in transfer to the relevant or appropriate agency;

  • third party consultations are required, in which case an additional 30 days may be added;

  • additional time is requested from the Information Commissioner in cases of complex or voluminous requests; or

  • a decision has been made to impose charges and those charges have not yet been paid.

If you disagree with our decision

If you disagree with NOPSEMA's decision on an FOI request (either as an applicant or an affected party) you may seek a review of that decision.
