Updates to NOPSEMA's information sharing policy
NOPSEMA has made updates to its Sharing information with Australian and international agencies policy to reflect recent information sharing amendments to the Offshore Petroleum and Greenhouse Gas Storage Act 2006, which are now in effect following the passage of the Regulatory Reform Omnibus Bill 2025 at the end of last year.
The purpose of these reforms supports a whole-of-government approach to modernise outdated rules, improve regulator performance and avoid the need to collect information from the oil and gas industry more than once. The changes also help to improve interagency coordination and response during emergency management situations.
Under the changes:
- NOPSEMA can share offshore information and things with more entities, including any Commonwealth agency, for the exercise of that agency's powers or functions under legislation (subject to any written conditions).
- The responsible Commonwealth Minister, the Titles Administrator, the Secretary of DISR and members of a Joint Authority or Cross-boundary Authority can also share information and things with the same agencies as NOPSEMA.
- Offshore information can be shared by the NOPSEMA CEO, the Titles Administrator, the Responsible Commonwealth Minister, and the Secretary of DISR with Commonwealth, State and Territory agencies for managing or responding to an event where a significant offshore petroleum incident direction has been given or an oil pollution emergency has been declared.
You can view NOPSEMA's updated policy on the NOPSEMA website.
The new amendments can also be found on the Federal Register of Legislation website along with the Explanatory Memorandum which identifies the specific changes.
