NOPSEMA investigations: information for witnesses
NOPSEMA has published a new brochure, NOPSEMA investigations: information for witnesses, to help people understand what to expect if they are asked to provide information during an investigation.
This plain-language guide has been developed for people who may be contacted by NOPSEMA because they have information relevant to an investigation. It provides practical guidance about the investigation process, explains witness rights and responsibilities, and outlines the protections available to people who assist NOPSEMA investigations.
The resource includes information about:
- voluntary and compulsory information-gathering processes
- witness rights and responsibilities
- protections against self-incrimination when information is provided under compulsory powers
- protections from discriminatory conduct for people who assist NOPSEMA or raise health and safety concerns
- support available when providing information to NOPSEMA, including the option to have a support person present.
The brochure also includes a frequently asked questions section covering topics such as:
- why NOPSEMA seeks information from witnesses
- whether participation in a voluntary interview is mandatory
- what happens if information is not provided voluntarily
- whether a support person or employer can attend an interview
- how the information provided may be used
- whether a person should seek independent legal advice.
The brochure is intended to help witnesses better understand their role in the investigation process and provide confidence about the legal protections and support available to them.
