Consent to electronic communications

As part of the Australian Government’s Digital Continuity 2020 Principles, NOPSEMA is changing the way it issues correspondence relating to its regulatory operations. From 1 October 2018, all NOPSEMA regulatory letters will bear a signature authorisation number (SAN) in place of a traditional signature; this change follows a successful 10 month trial. In addition, such letters will only be sent via electronic means in the form of a searchable PDF document and no longer posted. The Electronic Transactions Act 1999 requires NOPSEMA to obtain your consent for this purpose.

All NOPSEMA forms and submission portals have been updated to allow the capture of consent for managing communications be electronic means only. When sending email requests to NOPSEMA you are providing your consent.

By consenting to receiving communications electronically you acknowledge that:

  • Electronic communication from us will either direct you to a website from which the document can be downloaded, or the communication itself will contain the information within or as an attachment.  Such communication shall include an electronic representation of a signature authorisation.

  • Communications will include, but not limited to, giving of any notices and documents as required by or under the Offshore Petroleum Greenhouse Gas Storage Act 2006 (OPGGSA Act) or its regulations.

  • Communication shall be in a form which can be downloaded, printed and /or saved by your organisation.  It is your responsibility to retain the communication provide by us in a manner and in accordance with your business practices for record keeping.

  • NOPSEMA will not issue paper copies of material delivered by electronic means. However we may, at our option, deliver information on paper (such as during on-site inspections).

  • You are responsible for ensuring email contact details are up to date by writing to us at information@nopsema.gov.au allowing 2 business days for processing.

  • You may withdraw your consent at any time by writing to us at information@nopsema.gov.au allowing 5 business days for processing. If you withdraw consent we will not be able to continue processing via electronic means and will revert to paper advice only with all correspondence being delivered via Australia Post only. 

While all efforts are made to provide good IT security practices and establish appropriate technical and personnel controls, NOPSEMA or the Australian Government accepts no responsibility for the security or integrity of any information sent to or by NOPSEMA over the internet or by other electronic means.
